Igboho: Court Rejects Malami's Application for Vacation of Interim Order

An Oyo State High Court has rejected the move by the Attorney General of the Federation and Minister of Justice Abubakar Malami to vacate the interim order granted to the Yoruba Activist, Sunday Adeyemo, also known as Sunday Igboho.

Malami, through his Counsel, Simeon Enoch at the hearing of the case instituted by the Yoruba Activist on Monday informed the court of an application seeking the leave of the court to vacate the order.

Correspondent Kunle Ojo reports that the presiding Judge, Justice Oladiran Akintola said granting the application would render all actions taken so far on the matter invalid.

Justice Akintola maintained that time was of essence adding that the case has to do with right to life, property and freedom.

The presiding judge stated that his intention at today's hearing was to hear all applications on the matter without further delay.

After much debate on the application, the court refused to listen to the same.

Counsel to Malami, thereafter, asked for an adjournment for his client to respond to the counter-affidavits filed by counsel to Sunday Igboho on the matter of jurisdiction raised by the Attorney General of the Federation and Minister of Justice at the last sitting.

Although Counsel to the Yoruba Activist, Yomi Aliu vehemently rejected the application, the court maintained that Malami still has some hours to respond to the counter-affidavits.

Justice Akintola, therefore, adjourned the case to September 7th, 2021 while he further ruled that the interim order granted the Yoruba Activist still subsist.

All attempts to get the reaction of Counsel to the Attorney General and Minister of Justice, Simeon Enoch and Counsel to the Department of State Security Service to the proceedings failed as they hurriedly left the court.

Counsel to the Yoruba Activist, Yomi Aliu, (SAN) accused the Attorney General of playing pranks.

He also accused the Department of State Security Service of tampering with the Judgment of an Abuja court that ordered the release of the aides to the Yoruba Activist, Sunday Igboho.
