All members of the panel agreed to the position taken by Justice  Garba J.C. who prepared and read the judgement.The only ground thrashed out by the Apex court was the allegation by the labour party that the Second respondent is a citizen of a Nigeria when he participated in the 2023 Governorship election in Lagos State.

   The Court held that the Appellant failed to proof that the second respondent abandoned his citizenship of Nigeria as claimed with tangible evidence adding that, there is no provision in the constitution of Nigeria that removes citizen from the birth from anybody for acquiring citizenship of another country.
